Property compensation review

A LEADING expert in property compensation law has welcomed the State government’s commitment to examine and review compensation legislation as it applies to property rights.

University of Technology Sydney Asia-Pacific Centre for Complex Real Property Rights deputy director John Sheehan - who is also the chair of the Australia Property Institute’s government liaison committee - said the legislation needed better clarity as to how land was defined.
 
Minister for Finance and Services Greg Pearce said the review into the Land Acquisition (Just Terms Com-pensation) Act fulfilled an election promise to examine the legislation as part of the State government’s Strategic Regional Land Use Policy.
 
"It is well known that compulsory acquisition of private land and its impacts have been an ongoing area of stakeholder concern for many years," he said.
 
The government has appointed David Russell SC to prepare an issues paper which would facilitate public consultation.
 
NSW Farmers president Fiona Simson said property rights were a key challenge for the association’s 9000 members, as well as for protecting food security.
